Terms of Use

These Terms of Use (“Terms”) govern your use of the Boat File mobile application, website, and related services (collectively, the “Service”), provided by Boat File Inc (“Boat File”, “we”, “us”, “our”). By downloading, installing, or using Boat File, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Who can use Boat File • You must be at least 16 years old (or the age of digital consent in your country) to use Boat File. • By using the Service, you confirm that: • You have the legal capacity to enter into a binding agreement, and • Your use of the Service complies with applicable laws in your country. You are responsible for ensuring that your registration information is accurate and kept up to date.
2. Description of the Service Boat File is a digital tool for boat owners and boaters to: • Store and organize boat details and documentation • Track maintenance, projects, and other boat-related information • Keep logs relevant to their boating activities. Boat File is not: • A certified logbook under any national law • A navigation or safety-critical system • A substitute for official records required by authorities. You remain fully responsible for complying with all boating, safety, and documentation requirements in your jurisdiction.
3. Account and security To use the Service, you may need to create an account (e.g., using email + password or sign-in via a third party such as Apple or Google). You are responsible for: • Maintaining the confidentiality of your login credentials • Restricting access to your devices • All activities that occur under your account. If you suspect unauthorized access, you must inform us as soon as possible at info@boatfile.com.
4. Your content and ownership. You retain ownership of all content you upload or create in Boat File, including: • Boat data and details • Maintenance logs and notes • Documents, images, and other files By using the Service, you grant Boat File a limited, non-exclusive, worldwide, royalty-free license to: • Store, process, back up and display your content • Use it as necessary to operate and improve the Service. We do not claim ownership of your documents or logs. You are solely responsible for: • The accuracy of your content • Ensuring you have the necessary rights to upload and store it • Creating your own backups of important data
5. Prohibited uses You agree not to use the Service: • For any illegal purpose • To upload or share content that is: • Unlawful, harmful, defamatory, or infringing on third-party rights • Malware, spam, or other harmful code • To attempt to reverse-engineer, decompile, or tamper with the Service • To interfere with or disrupt the Service or its infrastructure • To circumvent security or access controls. We reserve the right to suspend or terminate your access if we reasonably believe you are violating these Terms.
6. Third-party services Boat File integrates with and relies on third-party services, for example: • Apple App Store and Google Play for distribution and billing • Firebase, Supabase, and other cloud services for storage, authentication, and analytics Your use of these services may be subject to their separate terms and privacy policies. Boat File is not responsible for third-party terms, availability, or actions, but we choose reputable providers and implement appropriate safeguards.
7. No reliance on the Service (important) The Service is provided as a convenience and organizational tool. You acknowledge that: • The Service may sometimes be unavailable (maintenance, outages, connectivity issues). • Data may, despite our efforts, be lost, delayed, or corrupted (e.g., due to device failure, network problems, user error, or third-party issues). • Boat File does not replace: • Official ship’s logs or statutory documentation • Certified navigation systems or charts • Professional advice, inspections, or maintenance services You are responsible for: • Maintaining independent backups of critical documents and logs • Using updated and official navigation and safety information • Ensuring your vessel is operated and maintained according to laws and best practices.
8. Fees and purchases Boat File may be offered as: • A free app, • A paid app, and/or • A subscription or in-app purchase model, depending on your region and platform. Any paid features, pricing, and billing conditions will be displayed in the app store (Apple / Google) or within the Service. Those terms provided by Apple or Google (including refund rules) will apply in addition to these Terms.
9. Termination You may stop using the Service at any time and may request deletion of your account by contacting us or using in-app tools where available. We may suspend or terminate your access to the Service, with or without notice, if: • You materially breach these Terms, • You misuse the Service or engage in illegal activity, or • We decide to discontinue the Service (in which case we will, where possible, give reasonable notice). Upon termination: • Your right to use the Service ends. • We may delete or anonymize your data in accordance with our Privacy Policy and legal obligations.
10. Disclaimer of warranties The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to: • Warranties of merchantability • Fitness for a particular purpose • Non-infringement • Availability, reliability, or accuracy of the Service We do not warrant that: • The Service will be uninterrupted, secure, or error-free • Any defects will be corrected • Data stored or synced through the Service will always be preserved or remain available
11. Limitation of liability To the extent permitted by applicable law: • Boat File and its owners, directors, employees, and service providers shall not be liable for: • Indirect, incidental, special, consequential, or punitive damages • Loss of profits, revenue, data, goodwill, or business opportunities • Any loss arising from reliance on data stored in the Service • Our total aggregate liability arising out of or relating to the Service or these Terms is limited to: • The amount you have paid to us (if any) for use of the Service in the 12 months immediately preceding the event giving rise to the claim; or, if you have not paid any amount, • A maximum of €50. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (for example, liability for intentional misconduct or gross negligence under Finnish law where applicable).
12. Data protection Our processing of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
13. Changes to the Service and to these Terms We may update and improve the Service over time, including by adding or removing features. We may also update these Terms from time to time. When we make significant changes, we will: • Update the “Last updated” date, and • Notify you via the app and/or website, or by email where appropriate. If you continue to use the Service after the updated Terms take effect, you are deemed to have accepted them. If you do not agree, you must stop using the Service.
14. Governing law and jurisdiction These Terms are governed by the laws of Finland, without regard to conflict of law principles. Any disputes arising out of or relating to the Service or these Terms shall be subject to the exclusive jurisdiction of the courts of Finland, with the Helsinki District Court as the first-instance court, unless mandatory law provides otherwise.
